These Terms of Service govern your access to and use of LabelMaker, including labelmakerai.com, the LabelMaker app, the LabelMaker API at api.labelmakerai.com, checkout, account dashboards, design tools, upload tools, proof approval, subscriptions, and related services.
By using LabelMaker, creating an account, approving a proof, placing an order, creating an API key, or making a payment, you agree to these Terms. If you use LabelMaker for a business, you represent that you have authority to bind that business.
LabelMaker provides AI-assisted label design, uploaded artwork review, saved brand kits, proof generation, print preparation, custom label and sticker ordering, order tracking, self-serve API access, prepaid API billing tools, webhooks, and support workflows for product labels and related packaging runs.
Supported product categories may include wine, beer, coffee, candles, skincare, supplements, stickers, and other consumer products. Availability, sizes, materials, finishes, turnaround times, shipping destinations, and API features may change over time.
You are responsible for maintaining the confidentiality of your account credentials, checkout sessions, saved projects, API keys, webhook secrets, and devices. You are responsible for all activity under your account or API keys.
You must promptly notify us if you believe your account or API keys have been compromised. We may suspend, revoke, rotate, throttle, or disable accounts, API keys, webhook endpoints, or orders to protect the service, prevent abuse, comply with law, or enforce these Terms.
You retain ownership of logos, images, artwork, label copy, product details, brand assets, prompts, files, and other materials you upload or provide. You grant LabelMaker a non-exclusive license to host, copy, modify, process, display, transmit, and create derivative files from that content as needed to provide the service, generate designs, prepare proofs, process orders, provide support, and fulfill production.
You represent that you have the rights and permissions needed to upload and use your content, and that your content does not violate law, third-party rights, platform rules, or these Terms.
LabelMaker may generate design concepts, copy suggestions, mockups, print files, and other outputs using AI systems and design tools. We do not claim ownership of your uploaded content or your final label project, but AI-generated outputs may not be unique and similar outputs may be created for other users.
You are responsible for reviewing all generated output before using it. We do not guarantee that generated text, barcodes, QR codes, nutrition facts, supplement facts, ingredient lists, claims, warnings, translations, dimensions, colors, or regulatory elements are accurate or compliant.
Before ordering, you must review and approve the exact artwork, including spelling, product details, claims, required warnings, facts panels, barcode or QR behavior, sizing, bleed, safe area, and production specifications.
You are solely responsible for confirming that your labels comply with applicable laws, regulations, marketplace rules, industry standards, and product requirements. This includes alcohol, food, supplement, cosmetic, safety, environmental, country-of-origin, and advertising rules that may apply to your product.
Custom label and sticker orders are produced from the approved proof and selected specifications. Colors, materials, coatings, cut tolerances, placement, finish, and packaging may vary between digital previews and physical production.
Production timelines are estimates and may depend on proof approval, file quality, provider availability, payment status, material availability, shipping carrier performance, and manual review. We may reject, cancel, pause, or request changes to an order if files are unusable, content is prohibited, pricing is incorrect, payment fails, fulfillment is unavailable, or the order creates operational or legal risk.
Payments are processed through Stripe or another payment provider we designate. You authorize us and our payment processors to charge the payment method you provide for orders, subscriptions, API top-ups, taxes, shipping, and other fees shown at checkout or in the API billing flow.
Prices may change before checkout. Custom quotes, API prepaid balances, held balances, subscriptions, discounts, minimum order values, and provider costs may be updated or corrected if an error is detected. Subscription plans renew until cancelled, unless stated otherwise in the applicable checkout flow.
Because orders are custom printed, orders generally cannot be cancelled or refunded after proof approval, payment, or production handoff unless we determine there was a production defect, shipping issue, duplicate charge, or other issue that warrants a remedy.
If there is a problem with an order, contact support with photos, the order number, and a description of the issue. Our remedy may be a reprint, credit, partial refund, full refund, or no remedy, depending on the circumstances and the stage of production.
You may not use LabelMaker to create, upload, sell, or distribute illegal, infringing, deceptive, harmful, hateful, abusive, sexually exploitative, malicious, counterfeit, fraudulent, or privacy-invasive content.
You may not interfere with the service, bypass rate limits, scrape non-public areas, probe systems without authorization, use stolen payment methods, create misleading product labels, impersonate others, misuse API keys, send unlawful webhook traffic, or use the service in a way that could harm LabelMaker, our providers, our customers, or the public.
LabelMaker relies on third-party services for authentication, hosting, databases, file storage, AI generation, image processing, payment processing, email, analytics, monitoring, printing, fulfillment, shipping, and API infrastructure.
Third-party services may have their own terms, privacy notices, availability limits, and processing rules. We are not responsible for third-party outages, delays, decisions, or platform changes, but we will work to keep the LabelMaker service operating reasonably.
LabelMaker, our software, templates, workflows, prompts, design systems, pricing tables, documentation, brand names, and service content are owned by LabelMaker or our licensors and are protected by intellectual property laws.
You may use LabelMaker only as permitted by these Terms. You may not copy, resell, reverse engineer, or create competing services from our software, templates, private documentation, API behavior, or non-public service content except as allowed by law.
LabelMaker is provided on an as-is and as-available basis. We do not warrant that the service will be uninterrupted, error-free, secure, compliant for your product, or free from data loss.
We do not provide legal, regulatory, tax, medical, food-safety, alcohol-compliance, supplement-compliance, cosmetic-compliance, or professional advice. You should consult qualified professionals for regulated labeling, product claims, safety warnings, and compliance questions.
To the maximum extent permitted by law, LabelMaker will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of goodwill, data, revenue, production time, business opportunity, or product inventory.
To the maximum extent permitted by law, our total liability for any claim related to the service will not exceed the greater of the amount you paid to LabelMaker for the affected order or service in the three months before the event giving rise to the claim or one hundred dollars.
You agree to defend, indemnify, and hold harmless LabelMaker from claims, losses, liabilities, damages, costs, and expenses arising from your content, products, labels, claims, uploaded files, API usage, webhook usage, orders, breach of these Terms, violation of law, or infringement of third-party rights.
We may update the service and these Terms from time to time. If changes are material, we will update the date above and, when appropriate, provide notice through the service or by email.
We may suspend or terminate access to the service if you violate these Terms, create risk for the service, fail to pay, misuse the API, or if continued service is not commercially or legally practical. You may stop using LabelMaker at any time.
These Terms are governed by the laws of the United States and the state where LabelMaker is operated, without regard to conflict-of-law rules. Courts located in that jurisdiction will have exclusive jurisdiction unless applicable law requires otherwise.
